Fire regulation

There are a significant number of laws and regulations regarding fire safety that are applicable in the Brussels-Capital Region.

Article 1 of the Act of 30 July 1979 Opens in new window(read more) on this matter states that "fire safety encompasses all safety measures aimed, on the one hand, at avoiding the outbreak of a fire, detecting any signs of fire outbreak and preventing it from spreading and, on the other hand, at alerting emergency services and facilitating both the rescue of individuals and the protection of property in the event of a fire."

In Belgium, fire safety is a federal responsibility. The federal government can therefore establish basic fire safety standards that apply to one or more categories of buildings, regardless of their purpose.

In addition to these basic standards, there are sector-specific standards issued by the federal government, Regions, Communities and  municipalities, depending on the specific competences of these entities. These specific standards complement the federal basic standards.

For buildings undergoing renovation, repurposing and/or transformations, there are no legal requirements, whether in the form of a Royal Decree (RD), an ordinance or a decree of the Government of the Brussels-Capital Region. The European Green Deal merely states that fire safety measures may be included in the event of long-term renovations. In the absence of existing regulations, the fire service outlines additional requirements in its advice, imposed as conditions in the permit or certificate to be issued. The aim is to ensure an equivalent level of fire safety for these unregulated cases, matching or approximating as closely as possible the provisions of the Royal Decree on "Basic Standards". These additional requirements are based on the firefighters’ experience and general knowledge of fire safety, and are intended to:

  • prevent the outbreak, development and spread of a fire;
  • ensure the safety of individuals present;
  • facilitate the intervention of the fire service as a precautionary measure.

What are the different regulatory texts?

There are a significant number of regulations regarding fire safety that apply in the Brussels-Capital Region. Most are listed below:

All buildings to be built, as well as extensions to existing buildings, regardless of their intended use.

The term "existing buildings" refers to high- and medium-rise buildings for which a building permit application was submitted before 26 May 1995, and low-rise buildings for which a building permit application was submitted before 1 January 1998.

Exemptions from basic safety standards

In certain cases, it is possible to obtain an exemption from some of these standards.

Article 2, § 2, of the Act of 30 July 1979 (External linkread more) authorises the Federal Public Service Home Affairs to grant exemptions from basic safety standards, provided that the construction to which these exemptions apply maintains a level of safety at least equivalent to that required by these standards.
