Conditions

Who can request an opinion from the Commission?

  • Any person with an interest in requesting an opinion on the fairness of the rent (tenant, trade union, etc.)
  • The landlord or the party filing a request on their behalf:
    • After the first three years of the lease, when it appears that the rent, at the time of the request, is 30% below the reference rent, unless this difference can be justified by substantial intrinsic quality defects, not attributable to the tenant, of the property or its environment.
    • When they wish to increase the rent, following work carried out to improve the leased property in order to improve the energy performance of the dwelling or to adapt the dwelling to the disability or loss of autonomy of the tenant.

For what type of tenancy agreement?

Any residential lease in the Brussels Region that meets the following two cumulative conditions:

  • not be entered into by a Public Real Estate Operator as defined in Article 2 § 1 4° of the Brussels Housing Code or a Social Real Estate Agency
  • the rent is not regulated by government order or decree.

Submitting an application

Important!

  • The opinion issued by the Joint Rental Commission is free of charge and non-binding.
  • The anonymised opinion will be published on the Brussels Housing website
  • Please attach a copy of the following documents to your application:
    • the tenancy agreement
    • all the documents needed to determine the fairness of the rent (description of the situation, photos of the property, reference rent, etc.).

What happens next?

  1. The applicant receives an acknowledgement of receipt once the application has been received. The other party to the lease is informed of the application for an opinion.
  2. Following receipt of a notice to attend, the different parties (and any authorised representatives and interested parties) will be heard at a meeting of the Joint Rental Commission.
  3. If necessary, the Commission members suggest holding one or more new meetings.
  4. The Joint Rental Commission issues an opinion within two months of the application being made.
  5. In the event of a rent review, it proposes conciliation between the parties to the lease.
  6. The parties are informed of the opinion no later than 15 days after the (final) meeting.
  7. The anonymised opinion is published on the Brussels Housing website no later than 30 days after notification.
