Cease and desist order

A cease and desist order, or an action for an injunction is a legal procedure used to stop or prohibit an infringement.

What is an action for an injunction?

In the context of unoccupied properties, an action for an injunction forces a property owner to end the vacancy of their property

At the request of the administrative authorities or an Opens in new windowassociation approved by the Government, the President of the Court of First Instance, ruling in summary proceedings, may order the holder of a real right on the property or, in the case of a property subject to a public management right, the public management operator concerned, to take all appropriate measures to ensure the property's occupancy within a reasonable timeframe.

The Regional Service for Unoccupied Housing supports public management operators (municipalities, PCSWs) in their various initiatives to return unoccupied housing to the market.

This legal support includes in particular launching actions for an injunction

Brussels Housing can also initiate actions for an injunction itself.
